Field & Hearth Notary Services

These Terms of Service apply to all Remote Online Notarization (RON) and mobile notary services provided by Field & Hearth Notary Services.
1. Nature of Notary Services
Notary services are limited to performing lawful notarial acts, including verifying identity, witnessing signatures, administering oaths or affirmations, and completing notarial certificates.
Field & Hearth Notary Services does not provide legal advice, legal representation, or document preparation services.
2. Client Responsibility for Documents
Clients are responsible for ensuring that all documents are complete, accurate, and appropriate for their intended use prior to the notarization session.
Clients are also responsible for confirming any document requirements, including but not limited to:
- witness requirements
- formatting instructions (including ink color, paper size, or signature placement)
- jurisdictional or receiving-party requirements
- document acceptance or filing requirements
Field & Hearth Notary Services is not responsible for document rejection, filing issues, or transaction outcomes.
3. Notarial Act Selection
Clients are responsible for selecting the appropriate notarial act required for their document, including acknowledgments, jurats, oaths, or affirmations. The notary does not determine or provide legal advice regarding the correct notarial act.
4. Representative Signers (POA / Business / Trust / Authority)
Individuals signing on behalf of another person or entity (including but not limited to power of attorney, trustees, business representatives, or authorized agents) are responsible for ensuring they have valid and sufficient authority to sign.
Field & Hearth Notary Services does not verify legal authority beyond observing proper execution of the notarial act and does not determine the validity or sufficiency of any power of attorney, trust authority, or business authorization.
Certain notarial acts, such as jurats or sworn statements, require the personal oath or affirmation of the individual making the statement.
5. Witness Requirements
Clients are responsible for determining whether witnesses are required and ensuring that any witnesses provided meet applicable requirements. Witness eligibility may vary depending on document type, jurisdiction, or receiving party. The notary does not verify legal relationships or witness eligibility beyond the notarial process.
6. Identity, Technology, and Platform Requirements
Clients must provide valid identification and ensure access to required technology, including a functioning camera, microphone, and stable internet connection.
Remote Online Notarization services may be conducted through third-party platforms that may require additional identity verification and account access.
7. Session Integrity and Right to Refuse Service
Notarial services may be paused, delayed, or declined if:
- identity cannot be verified
- required conditions are not met
- document concerns arise
- signer unwillingness or coercion is suspected
- platform or technical issues prevent completion
Remote Online Notarization sessions include secure recording and audit trail systems for compliance and fraud prevention.
8. Payment, Cancelations, and Refunds
All fees for Remote Online Notarization and mobile notary services are due upon completion of services unless otherwise agreed in advance.
Appointments may be subject to cancellation or rescheduling based on availability, technical issues, or client readiness.
Refund Policy
Completed notarial services are non-refundable.
Refunds will not be issued for:
- incorrect or incomplete documents
- failure to meet witness or document requirements
- client misunderstanding of document requirements or acceptance by third parties
- platform, jurisdictional, or filing-related issues outside of the notary’s control
- cancellation or interruption caused by client-related issues
If a clerical or notarial error is made by Field & Hearth Notary Services, the error will be corrected at no additional charge.
No refunds are provided for completed notarizations.
9. Appointment Requests
Submitting a request does not guarantee appointment acceptance. All appointments are subject to availability, document type, and service suitability.
10. Limitation of Liability
Field & Hearth Notary Services is not responsible for delays, rejections, filing issues, or transaction outcomes resulting from:
- incorrect or incomplete documents
- missing witnesses or improper execution
- jurisdictional or receiving-party requirements
- client-provided information
- third-party decisions or platform restrictions
The notary’s responsibility is limited to properly performing lawful notarial acts for the signer(s) present.
11. Agreement to Terms
By requesting services, the client acknowledges and agrees to these Terms of Service.
